The terms, in plain words.

These terms are a binding agreement between you and Aeterna Systems ("e0", "we", "us"), the makers of e0. By downloading, installing, or using e0, you accept them. If you don't agree, please don't use e0. If you're using e0 for an organisation, you confirm you're allowed to accept these terms on its behalf.

e0 lets you run open models on your own device, across your own machines (your mesh), on e0's comped fleet, and — by explicit choice — on third-party cloud models. It is early software under active development. Features will change, models may go down during updates, and things may break. We share it in this state on purpose, and we ask you to treat it as the work-in-progress it is.

During the beta, the e0 fleet and a starting amount of e0 cloud usage are comped — provided at no charge as a Founder's Gift while we test. This is a gift, not a contract for a paid service, and we may change or end it. If paid plans arrive later, we'll tell you clearly before anything is charged.

Everything you create with e0 — your prompts, conversations, files, and the models' outputs to you — belongs to you. We claim no ownership of it and no licence to use it. Because on-device and mesh routes keep your content on your own hardware, we typically never see it at all. You are responsible for the content you create and for keeping your own backups; your local data lives on your device and is removed when you uninstall.

You agree not to use e0 to:

break the law or help others do so; create content that sexually exploits or endangers children; generate targeted harassment, malware, or fraud; infringe others' rights; or abuse the comped tiers — for example by reselling access, evading usage limits, or hammering the shared infrastructure in a way that degrades it for everyone. e0 gives you real capability; use it as you'd want others to use theirs.

The e0 Cloud and bring-your-own-key tiers are cloud routes that run off your device. Some e0 Cloud tiers may currently route to a third-party model provider to generate a reply (we are moving these toward e0's own sovereign cloud), and a bring-your-own key always goes directly to the provider you chose — as described in our Privacy Policy. When a third-party provider is involved, its own terms and privacy practices also apply to that request; we don't control those providers or their availability. On-device, mesh, and e0 fleet routes don't involve them.

To the fullest extent the law allows, e0 is provided "as is" and "as available", without warranties of any kind — express or implied — including fitness for a particular purpose, accuracy, or uninterrupted availability. Models can be wrong, incomplete, or unexpected; don't rely on e0 for medical, legal, financial, or other professional decisions without qualified human judgement. Nothing here excludes rights that can't be excluded under laws such as the Australian Consumer Law.

To the extent permitted by law, and except where a warranty cannot be excluded, Aeterna Systems will not be liable for indirect, incidental, or consequential losses arising from your use of e0, and our total liability for any claim will not exceed what you paid us for e0 in the prior twelve months — which, during the comped beta, is nothing. Some jurisdictions don't allow these limits, in which case they apply only as far as the law allows.

You can stop using e0 at any time by uninstalling it — your local data goes with it. We may suspend or end access, or discontinue the beta or a tier, if we need to (for example, to protect the service or comply with the law); where it's reasonable, we'll give notice. Because your content lives with you, ending access does not take your data from you.

We may update these terms as e0 evolves. When changes are material, we'll update the date above and, where significant, note it in the app; continuing to use e0 means you accept the current version, always available at this URL. These terms are governed by the laws of New South Wales, Australia, and you agree to the non-exclusive jurisdiction of its courts — without limiting mandatory consumer protections in your own country.
